1. General Information
1.1 This website (Site) is operated by Tutor Me Australia (we, us, our). We provide tutoring and education services, including but not limited to school support, IELTS preparation, university preparation, exam coaching, holiday programs, online learning and related educational resources (Services).
1.2 Our principal place of business is located at Australia.
1.3 These Terms and Conditions (Terms) apply to all users of our Site and Services, including parents/guardians and students.
1.4 By accessing or using the Site, registering for an account, enrolling in any program, or otherwise engaging our Services, you agree to be bound by these Terms.
1.5 These Terms are governed by the laws of Australia, and the parties submit to the exclusive jurisdiction of the courts of that State or Territory and the Commonwealth of Australia.
2. Acceptance of Terms
2.1 Please read these Terms carefully. If you do not agree to these Terms, you must not use the Site or our Services.
2.2 We may update these Terms from time to time by publishing an updated version on the Site. Any changes take effect from the date of publication. Your continued use of the Site or Services after the updated Terms are posted constitutes acceptance of the updated Terms.
2.3 Additional terms or policies (such as our Privacy Policy, enrolment forms, program-specific conditions or COVID-19 operational updates) may apply to certain Services. Where there is any inconsistency, those additional terms will prevail to the extent of the inconsistency with respect to the relevant Service.
3. Eligibility and Use of the Site
3.1 The Site is intended for use by individuals residing in Australia. If you access the Site from outside Australia, you are responsible for compliance with local laws.
3.2 Our Services are generally provided to school-aged children, adolescents and university students. Where a student is under 18 years of age, a parent or legal guardian must:
(a) complete the enrolment on the student’s behalf;
(b) consent to the student’s participation in our Services; and
(c) accept and ensure compliance with these Terms.
3.3 You must not use the Site or Services:
(a) for any unlawful or fraudulent purpose;
(b) to harass, bully, defame, abuse or threaten any other person;
(c) to distribute unsolicited commercial messages (spam);
(d) to upload or transmit any virus or harmful code; or
(e) in any way that interferes with or disrupts the integrity or performance of the Site, our online learning platform or our systems.
3.4 You must ensure that all information you provide to us is accurate, current and complete. You must promptly update your details if they change.
4. Tutoring Services & Programs
4.1 We offer a range of tutoring and education programs, which may include (without limitation):
school support and catch-up programs;
extension and advanced programs;
IELTS and English language support;
subject-specific programs (e.g. English Plus, Maths Plus and similar);
exam preparation, scholarship exam preparation and study skills programs;
holiday programs, master classes and workshops; and
online and remote learning programs.
4.2 The description of each program or Service is set out on the Site or in our enrolment materials. Program content, structure, duration and availability may vary depending on the student’s year level, campus, or online timetable.
4.3 While our aim is to support each student to reach their potential, we do not guarantee particular outcomes or grades, exam results, scholarships or admissions. Student progress depends on a range of factors, including attendance, engagement, homework completion, and individual circumstances.
4.4 Our programs are designed to support and supplement school or university education. We are not a registered school, university or higher education provider and do not confer any formal qualifications.
4.5 We may provide Services in-person at our campus locations (such as [Mulgrave campus / other locations]) and/or online via remote learning. Information about the mode of delivery, timetable and campus status (e.g. temporary closure due to government directives) will be communicated via the Site, email or other channels.
5. Enrolment, Bookings & Accounts
5.1 You may be required to create an online account to enrol a student, manage bookings or access remote learning resources. You must keep your login details confidential and must not share them with any other person.
5.2 You are responsible for all activity that occurs under your account. If you suspect unauthorised use, you must notify us promptly at [Contact Email].
5.3 Enrolment in a program is subject to:
(a) availability of places in the relevant class or time slot;
(b) our assessment of the student’s needs and level; and
(c) receipt of required enrolment information and payment arrangements.
5.4 We may allocate students to particular classes or tutors based on availability, level and other operational considerations. While we take preferences into account where possible, we do not guarantee a particular tutor or time slot.
5.5 We may from time to time operate under adjusted conditions (for example, during public health events) including:
shifting from campus-based learning to remote learning;
enforcing capacity limits, time-slotting or priority access (e.g. for VCE or vulnerable students); and
altering the delivery mode of particular classes.
We will use reasonable efforts to notify you of such changes.
6. Fees, Payment & Cancellations
6.1 Fees for our programs and Services are set out on the Site or in our enrolment forms or invoices. Unless expressly stated otherwise, all prices are in Australian dollars (AUD) and inclusive of GST (where applicable).
6.2 We may offer different fee structures (for example, term-based fees, per-session fees, package fees or holiday program fees). The applicable fee structure for your enrolment will be specified at the time of booking.
6.3 Payment terms:
(a) Fees are payable in advance of the relevant program or in accordance with the payment schedule notified to you.
(b) We may accept various payment methods (e.g. credit/debit card, bank transfer, direct debit or other methods as indicated on the Site).
(c) You authorise us (and our payment providers) to charge your chosen payment method for all amounts due.
6.4 We may change our pricing from time to time. Price changes will apply to new enrolments or future terms and will not affect fees already paid for a current term or confirmed booking, except as otherwise agreed.
6.5 Cancellations by you – regular sessions:
You acknowledge that our ability to deliver Services relies on committed bookings. Cancellation terms for regular weekly sessions and make-up lessons will be set out in your enrolment confirmation or fee schedule. In general:
(a) short-notice cancellations may not be eligible for a refund;
(b) we may, at our discretion, offer a make-up class or credit where reasonable notice is given; and
(c) any such policy will operate subject to your rights under the Australian Consumer Law.
6.6 Cancellations by you – holiday programs and workshops:
Due to limited places and scheduling requirements, cancellations or changes close to the start of a holiday program or workshop may attract a cancellation fee or may not be refundable. Specific conditions for each program will be notified at the time of booking.
6.7 Cancellations by us:
We reserve the right to cancel or reschedule a class, program or session due to low enrolments, tutor illness, campus closures, government directives or other circumstances beyond our reasonable control. Where we cancel a class or program and cannot provide a suitable alternative, we will offer you:
(a) a rescheduled session; or
(b) a credit; or
(c) a refund for the affected session(s),
in accordance with your rights under the Australian Consumer Law.
7. Refunds, Credits & Australian Consumer Law
7.1 Our refund and credit practices are intended to be fair and consistent with the Australian Consumer Law (ACL) contained in the Competition and Consumer Act 2010 (Cth).
7.2 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the ACL or any other applicable law that cannot be excluded, restricted or modified (Non-Excludable Rights).
7.3 Subject to your Non-Excludable Rights and any program-specific policy, we generally:
(a) provide refunds where we are required to do so under the ACL (for example, where Services are not provided with due care and skill, or are not fit for purpose, and cannot be remedied within a reasonable time);
(b) may offer credits or make-up sessions for missed classes or cancellations at our discretion; and
(c) are not obliged to provide a refund where you simply change your mind, decide you no longer wish to attend, or fail to attend without reasonable notice.
7.4 Any approved refund will be made using your original payment method (where possible) or another method agreed with you.
8. Online Learning Platform & Technology
8.1 We may use third-party platforms (e.g. video conferencing, learning management systems or other digital tools) to deliver remote learning, online tutoring and access to resources.
8.2 You are responsible for ensuring that you have suitable technology, internet access and equipment to participate in online sessions, including:
a reliable internet connection;
a compatible device (e.g. computer, tablet, smartphone); and
any required software or applications.
8.3 You must:
(a) keep login details and passwords secure and not share them with others;
(b) ensure that the student attends online sessions in an appropriate environment (e.g. quiet, safe, with appropriate supervision where required);
(c) not record, screenshot or distribute online sessions without our prior written consent, except where permitted by law.
8.4 We are not responsible for any loss, disruption or inability to access online sessions arising from failures of your equipment, internet connection, or actions of third-party service providers outside our reasonable control.
9. Student Conduct, Safety & Supervision
9.1 We seek to provide a safe and respectful learning environment for all students and staff. We expect students to:
(a) treat tutors, staff and other students with respect;
(b) follow reasonable instructions of tutors and staff;
(c) refrain from bullying, harassment, discrimination or disruptive behaviour; and
(d) use our materials, campus facilities and online platforms appropriately.
9.2 We may suspend or terminate a student’s participation in our Services (with appropriate notice) where behaviour is consistently inappropriate, unsafe or seriously disruptive, or where there is a breach of these Terms or our codes of conduct.
9.3 For in-person Services, our duty of care applies during scheduled sessions at our campus or designated locations. Parents and guardians remain responsible for the student’s travel to and from the venue and for timely drop-off and collection.
9.4 For online Services, parents or guardians should provide a safe environment and appropriate supervision for students, particularly younger children.
9.5 Where a student has particular needs (e.g. learning disabilities, ADHD, hearing impairment or other conditions), we encourage parents/guardians to provide relevant information to support our planning. While we will use reasonable efforts to accommodate individual needs, we may not be able to provide specialised clinical or therapeutic support.
10. Intellectual Property
10.1 We (or our licensors) own all intellectual property rights in the Site, our programs, lesson materials, blog content, articles, handouts, videos, logos, trade marks, designs, and any other content we provide (Our Content).
10.2 Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use Our Content solely for personal, non-commercial educational purposes in connection with your or your child’s participation in our Services.
10.3 You must not (and must not permit any third party to):
(a) reproduce, copy, adapt, modify, publish, distribute, sell, sublicense, create derivative works from, or otherwise exploit Our Content;
(b) remove or obscure any copyright, trade mark or proprietary notices; or
(c) use any of our trade marks or branding without our prior written consent.
10.4 You acknowledge that some content on the Site may be provided for general information (e.g. blog posts about learning, homeschooling, tutoring tips). Such content is not professional advice and should not be relied upon as a substitute for educational, psychological, medical or financial advice from a qualified professional.
11. User Content & Testimonials
11.1 You may be able to submit content to us, including enquiries, feedback, reviews, testimonials, comments, homework tasks or other materials (User Content).
11.2 By submitting User Content, you:
(a) warrant that you have the right to submit the User Content and that it does not infringe the rights of any third party or any law;
(b) grant us a worldwide, royalty-free, perpetual, irrevocable, transferable licence to use, reproduce, adapt, publish, display and distribute the User Content in connection with our business (including on the Site and in marketing and promotional materials), in any media; and
(c) consent (and procure all consents) to us editing or anonymising User Content for clarity or privacy, provided we do not materially distort its intended meaning.
11.3 We may moderate or remove User Content at our discretion, including where it is offensive, defamatory, misleading, infringes third-party rights or otherwise breaches these Terms.
12. Third-Party Links & Resources
12.1 The Site may contain links to third-party websites, tutors, resources or services (Third-Party Sites). These are provided for convenience only.
12.2 We do not control, endorse or approve Third-Party Sites and are not responsible for any content, advertising, products or materials on or available from them.
12.3 Your use of Third-Party Sites is at your own risk and subject to the terms and conditions of those sites.
13. Disclaimer – No Guarantee of Results
13.1 While our tutors use their best efforts, experience and professional judgment to support student learning, you acknowledge that:
(a) each student’s progress depends on numerous factors beyond our control, including attendance, engagement, study habits and external circumstances;
(b) academic results, exam performance, scholarships, admissions or other outcomes cannot be guaranteed; and
(c) general information on the Site (including blog posts and articles) is provided for educational and informational purposes only and is not tailored to your specific circumstances.
13.2 To the extent permitted by law, we exclude all warranties, representations and guarantees not expressly set out in these Terms or required by the ACL.
14. Limitation of Liability
14.1 Nothing in these Terms excludes or limits any Non-Excludable Rights under the ACL or any other applicable law.
14.2 Subject to clause 14.1, and to the maximum extent permitted by law:
(a) our liability for failure to comply with a consumer guarantee under the ACL in relation to the supply of Services is limited, at our option, to:
(i) resupplying the Services; or
(ii) paying the cost of having the Services supplied again; and
(b) we are not liable for any indirect, consequential or special loss or damage, loss of opportunity, loss of profit, or loss of data, whether arising in contract, tort (including negligence), equity, statute or otherwise, in connection with the Site or the Services.
14.3 To the extent permitted by law, our total aggregate liability to you for any loss or damage arising out of or in connection with the Site, the Services or these Terms (other than in relation to Non-Excludable Rights) is limited to the total amount of fees actually paid by you to us for the Services giving rise to the claim in the 12-month period immediately preceding the event giving rise to the claim.
15. Indemnity
15.1 You indemnify us and our officers, employees, contractors and agents against any loss, liability, damage, cost or expense (including legal costs on a full indemnity basis) arising from or in connection with:
(a) your breach of these Terms;
(b) any misuse of the Site or Services by you or by any person using your account;
(c) your infringement of any third-party rights, including intellectual property rights or privacy rights; or
(d) any User Content you submit.
15.2 This indemnity is reduced to the extent that the loss was caused or contributed to by our negligent or unlawful act or omission.
16. Privacy & Data Protection
16.1 We handle personal information in accordance with our Privacy Policy, which is available on the Site.
16.2 By using the Site or our Services, you consent to our collection, use and disclosure of personal information as described in our Privacy Policy, including information about students, parents/guardians and other users.
16.3 Our Privacy Policy forms part of these Terms. If you do not agree with our Privacy Policy, you must not provide personal information or use the Site or Services.
17. Changes to the Site and Services
17.1 We may, at any time and without notice, modify, suspend or discontinue any part of the Site or Services, including:
course offerings and program names;
timetables, class sizes and delivery modes (e.g. campus-based vs remote learning);
campus opening hours; and
the content of the Site (including blog posts and announcements).
17.2 Where changes materially affect an ongoing program for which you have already paid, we will use reasonable efforts to provide suitable alternatives (such as rescheduling, remote delivery or credits), in accordance with your rights under the ACL.
18. Suspension & Termination
18.1 We may suspend or terminate your access to the Site or Services (in whole or in part) where:
(a) you breach these Terms or any applicable policy;
(b) you fail to pay fees when due and do not remedy the non-payment within a reasonable time after notice;
(c) we reasonably consider that your conduct (or the conduct of a student linked to your account) is unsafe, abusive, disruptive or otherwise inappropriate; or
(d) we are required to do so by law or a government directive.
18.2 You may terminate your enrolment or stop using the Site at any time, subject to any applicable notice periods or fee commitments set out in your enrolment or program-specific terms.
18.3 Termination does not affect any rights or obligations which have accrued up to the date of termination, including any obligation to pay outstanding fees.
19. Complaints & Dispute Resolution
19.1 We are committed to addressing concerns promptly and fairly.
19.2 Please provide as much detail as possible, including your name, contact details, student’s name (if applicable), and the nature of your concern.
19.3 We will endeavour to acknowledge your complaint within a reasonable time and to work with you to resolve the issue.
19.4 Nothing in this clause prevents either party from seeking urgent injunctive or declaratory relief from a court of competent jurisdiction.
20. General Provisions
20.1 Severability – If any part of these Terms is found to be invalid or unenforceable, that part will be severed, and the remainder will continue in full force and effect.
20.2 Entire Agreement – These Terms, together with any enrolment forms, program-specific terms and our Privacy Policy, constitute the entire agreement between you and us regarding the Site and Services.
20.3 Assignment – You must not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights or obligations at any time, provided that doing so does not materially adversely affect your rights.
20.4 Waiver – A failure or delay by us in exercising a right does not operate as a waiver of that right. A waiver of a right must be in writing to be effective.
